Without limiting the foregoing, everything on the Site is provided to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

    Please note that the Consumer Guarantees Act 1993 in New Zealand and other legislation in other jurisdictions may confer rights and remedies on you in relation to the provision by Sony of goods or services on the Site which cannot be excluded, restricted or modified ("Non-excludable Rights"). Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties. Notwithstanding the foregoing paragraph, Sony does not exclude any Non-excludable Rights but does exclude all other conditions and warranties implied by custom, law or statute.

    Where the Consumer Guarantees Act 1993 applies to these Terms and Conditions:
    (a) if the goods or services are acquired by you for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply; and
    (b) if the goods or services are not acquired by you for business purposes, to the fullest extent permitted by law, Sony's liability for breach of any implied warranty or condition which cannot be excluded is limited, at the option of Sony, to: (i) in the case of services, the supply of the services again or the payment of the cost of having services supplied again; and (ii) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of such goods, the payment of the cost of replacing the goods or acquiring equivalent goods, or the payment of the cost of having the goods repaired.
  3. Features and specifications of products described or depicted on the Site are subject to change at any time without notice. Non-metric weights and measures are approximate. All monitor screens are measured diagonally; all monitor screen images contained in this database are simulated pictures unless otherwise indicated.
  4. Sony assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video, or audio from the Site.
  5.   7. The Site refers to products and/or services that are generally available for purchase in New Zealand but may not be available in your particular country or locality. The trademarks, including but not limited to, "AIWA", "SONY", "VAIO", "WALKMAN", "Trinitron", "i.LINK", and "Memory Stick" are trademarks of Sony and/or its affiliates. Any other trademarks used in the Site are trademarks of their respective owners.
